The short version: Awzsome helps you find local deals on WhatsApp. It is free for consumers, and currently free for businesses in Manteca and Lathrop. We are a signpost, not the shop: we do not run the businesses we list, we are not part of any sale, and we are not responsible for what businesses do. You must be 18 or older. Disputes go to individual arbitration, and our liability is capped.
These Terms of Service are an agreement between you and Awzsome, the business that provides this service from Manteca, California (“Awzsome”, “we”, “us”).
In these terms, “Awzsome Parties” means Awzsome together with its owners, founders, members, officers, directors, employees, contractors, agents, suppliers, licensors, affiliates, successors and assigns. Every protection in these terms, including the disclaimers, the limits on liability, the indemnities and the dispute terms, extends to each of the Awzsome Parties individually. Each of them is an intended third-party beneficiary of these terms and may enforce them.
When you first message Awzsome we send you links to these terms and to our Privacy Policy. By replying YES you agree to both. If you do not agree, reply NO or STOP and we will not proceed. When these terms change in a way that needs your agreement, we will ask you to reply YES again before you continue.
A business that lists a deal also agrees to the Business Terms in section 6, by replying AGREE when asked. We keep a record of when you agreed and which version you agreed to.
You must be 18 or older to use Awzsome. By accepting, you confirm that you are.
Awzsome is a task-specific service that helps you find deals from local businesses near you. It is delivered through WhatsApp.
Awzsome is automated. Your messages are read and answered by software, including AI services, not by a person, and its replies can be wrong or incomplete. To reach a person, email hello@awzsome.com or send HUMAN on WhatsApp.

Awzsome only shows deals held in our own database. It does not search the web and does not answer general questions. Deals come from two kinds of source:
We do not warrant that any deal or information is accurate, current, complete or available. Prices change, offers end, businesses close, and staff may be unaware of an offer. Always confirm with the business before you rely on anything you see on Awzsome. Listing a business or a deal is not an endorsement of it.
Awzsome is free for consumers. There is no subscription, no charge and no payment information required. Your mobile carrier’s standard data charges may apply.
Listing a business in Manteca and Lathrop, California is currently free. We may introduce charges for listings, including in other cities. No charge will ever apply to a business without its agreement first.
A business may pay to appear higher in results as a Featured listing. Featured listings are paid placement, are labelled as Featured, and are not a recommendation or endorsement by Awzsome.
This section applies to anyone who submits a deal or lists a business on Awzsome. You accept it by replying AGREE when asked, and again whenever we update it. If you submit a deal, you represent, warrant and agree that:
Deals we do not accept. You must not submit offers for alcohol, cannabis, tobacco or vaping products, firearms or weapons, adult or sexual content, gambling, prescription or controlled drugs, loans or credit, investments, cryptocurrency, or any guarantee of financial, medical or legal results, or any offer that is unlawful where it is made.
How long a deal runs. A published deal runs for two weeks unless you withdraw it earlier. Coupons customers claimed while it was live remain valid for a further seven days, and you agree to honour them during that time.
Messages to you. You agree that we may send you WhatsApp messages about your listings, including approvals, customer claims and reservation requests. A reservation request tells you the customer’s name and the deal; we never give you a customer’s phone number.
Our discretion. We may reject, edit for clarity or length, suspend or remove any submission or listing, at any time, without notice or explanation. You are solely responsible for every deal you submit and for honouring it.
When you claim a deal we give you a coupon beginning AWZM. The coupon identifies the offer; it is not money, has no cash value, and may not be sold. Whether to accept a coupon is the business’s decision, and any dispute about honouring a deal is between you and that business. We may cancel coupons we believe are being misused.
The Awzsome Parties are not responsible or liable in any way if a business refuses, changes, or fails to honour any deal, coupon or reservation, for any reason. Your remedy for a deal that is not honoured is against the business, not against Awzsome.
You may forward a deal to other people. Anyone who opens a forwarded deal and claims it does so under these terms.
A reservation on Awzsome is a request, not a booking. If the business has accepted our Business Terms, we pass your request (your name and the deal) to it. If it has not, nothing is sent to the business, and your reservation message is your record to show when you visit. In either case:

We may suspend or permanently remove anyone, at any time, without notice.
Awzsome relies on services we do not own or control, including WhatsApp and Meta, Google, OpenAI, and our hosting and database providers. If any of them changes, fails, restricts us or goes down, Awzsome may be delayed, degraded or unavailable, and the Awzsome Parties are not liable for that. We may change, suspend or discontinue Awzsome, in whole or in part, at any time.
Business listings, deals and offers are provided by or come from businesses, not from us. We do not endorse them and we are not responsible for them. Any dealings you have with a business, including quality, price, safety, licensing, service, refunds or payment, are strictly between you and that business.
The Awzsome name, logo, website and service belong to us or our licensors. You may not use them without written permission. By submitting content to us, you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, display, reproduce and adapt it to operate and promote the service. Business names and trade marks shown on Awzsome belong to their owners and are used only to identify the business.
To the fullest extent permitted by law, Awzsome is provided “as is” and “as available”, without warranty of any kind, express, implied or statutory. The Awzsome Parties expressly disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, accuracy and non-infringement. We do not warrant that Awzsome will be uninterrupted, timely, secure or error-free, or that any deal will be available or honoured.
To the fullest extent permitted by law, the Awzsome Parties shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to Awzsome, whether in contract, tort, negligence, strict liability or otherwise, even if advised that such damages were possible.
To the fullest extent permitted by law, the total aggregate liability of the Awzsome Parties for all claims arising out of or relating to Awzsome shall not exceed the greater of one hundred United States dollars (US$100) or the total amount you paid us in the twelve months before the claim arose.
These limits reflect a reasonable allocation of risk for a service provided free of charge, and are a fundamental basis of this agreement.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful injury or violation of law under California Civil Code section 1668.
You agree to indemnify, defend and hold harmless the Awzsome Parties from and against any claim, demand, loss, liability, damage, fine, cost or expense, including reasonable legal fees, arising out of or relating to: your use of Awzsome; your breach of these terms; your violation of any law or of anyone’s rights; or any content you submit.
Businesses additionally agree to indemnify, defend and hold harmless the Awzsome Parties from and against any claim arising out of or relating to: any deal or listing you submit; your failure to honour a deal, coupon or reservation request; the accuracy of anything you tell us; the goods or services you provide; your compliance with any law, licence or permit; and any dispute between you and a customer.
Please read this section carefully. It affects your legal rights, including your right to go to court and to bring a class action.
Talk to us first. Before starting any claim, send a written notice describing it, your WhatsApp number and the relief you want to legal@awzsome.com. Both sides agree to try in good faith to resolve it within 60 days. Any time limit is paused during those 60 days.
Binding individual arbitration. If it is not resolved, any dispute, claim or controversy arising out of or relating to Awzsome or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or, for disputes with a business, its Commercial Arbitration Rules) then in effect. The Federal Arbitration Act governs this section. The arbitrator, and not a court, decides all questions about the scope, validity and enforceability of this section, except as stated below. Arbitration fees are paid as the AAA rules provide. Unless you and we agree otherwise, any hearing will take place in San Joaquin County, California, or by video.
Exceptions. Either of us may bring an individual claim in small claims court instead, and either of us may seek a court order to protect intellectual property.
Class action waiver. You and we may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may award relief only to the individual party seeking it. If this waiver is found unenforceable for any claim, that claim must be decided by a court and not in arbitration, and this waiver is not severable from this arbitration agreement for that claim.
Public injunctive relief. Any claim seeking public injunctive relief under California law will be decided by a court in San Joaquin County after all arbitrable claims are resolved, and is stayed until then.
Mass filings. If 25 or more similar claims are filed against the Awzsome Parties by the same or coordinated counsel, they will be administered in batches of up to 25, with one arbitrator per batch, and the remaining claims will be stayed until each batch is resolved.
Time limit. To the fullest extent permitted by law, any claim must be brought within one year after it arises, or it is permanently barred.
Your right to opt out. You may opt out of this section by emailing legal@awzsome.com within 30 days of first accepting these terms, stating your WhatsApp number and that you opt out of arbitration. Opting out does not affect any other part of these terms.
Changes. If we change this section, the change will not apply to any dispute you notified us of before the change took effect.
These terms are governed by the laws of the State of California and applicable federal law, without regard to conflict of laws rules. Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in San Joaquin County, California, and you and we consent to their jurisdiction.
We may update these terms. If a change is material, we will tell active users by WhatsApp message where we are able to, and by posting the updated terms on this site, and where required we will ask you to agree again. Continuing to use Awzsome after a change takes effect means you accept the updated terms. If you do not accept them, reply STOP.
